Let me remind you (point of my last post) that right now it is not legal to try any citizen via military courts. There are FOUR high bars that must be surmounted in order for this to happen to civilians.
1.) Legislation must be written by the House defining domestic enemy combatants for the purpose of the Bill; that these defined enemy combatants will have habeas corpus suspended and be tried by Military courts. This law must pass the House vote to become a Bill.
2.) The above Bill must be ratified and passed into Law by the Senate.
3.) The President must sign the above Bill.
4.) The Supreme Court must uphold this law as constitutional against all challenges.
Unless and until that happens Military Law applies only to our military personnel and those civilians attached to them in the theater of combat. It does not apply to foreign enemy combatants apprehended on foreign soil. And it does not apply to any civilian who has the right of habeas corpus.
