The case was during the 1970's as I recall. It involved the Jehovah's Witnesses and a some town.

 

There was a gated area that the owners opened to to public so all could use the park and connecting streets.

 

Jehovah Witnesses started going door to door. Town stopped them saying it was private property.

 

SC ruled that because they had opened the streets to the public they could not now claim it to be private to block free speech.

 

Same law applies to real estate, if you have allowed me for years to cross your property to get to my house you now cannot close my access.

They can make you leave if tey haven't allowed free speech in the past, ie religious tracks handed out, talking to people about issues.

 

Now sitting lets say in the food court and talking to a friend, no as long as you aren't speaking really loud.
