This is all on the premise that HUssein is determined to be an illegitimate president.

 

If Hussein signed their commissions as an illegitimate president then they would be illegitimate and would step down on their own rather than creating a crisis and be forced off.

I took exception to the opinion that the senate confirmation made the justice legit, when it is the president's signed commission which makes the justice legit,

 

A confirmed justice does not have to serve.
