Judge upholds Monsanto verdict, cuts award to $78 million

SAN FRANCISCO (AP) — A Northern California judge on Monday upheld a jury’s verdict that found Monsanto’s weed killer caused a groundskeeper’s cancer, but she slashed the amount of money to be paid from $289 million to $78 million.

In denying Monsanto’s request for a new trial, San Francisco Superior Court Judge Suzanne Bolanos cut the jury’s punitive damage award from $250 million to $39 million. The judge had earlier said she had strong doubts about the jury’s entire punitive damage award.

Bolanos gave DeWayne Johnson until Dec. 7 to accept the reduced amount or demand a new trial.

Supreme Court blocks questioning of Wilbur Ross in census suit

The Supreme Court on Monday night blocked a federal court order demanding Commerce Secretary Wilbur Ross face questioning in a lawsuit challenging his decision to add a citizenship question to the 2020 census.

Why it matters: The decision is a major blow to the 18 states suing Ross, which argue that the additional question will discourage both legal and illegal immigrants from participating in the census. The census is used to determine electoral boundaries and the distribution of federal funds.

What's next: The Supreme Court's decision means that the trial in New York, set to begin on Nov. 5, will go forward without Ross’ deposition. However, the justices declined to halt the deposition for the acting head of the Justice Department's Civil Rights Division, John Gore, and ordered that the administration hand over more documents related to the issue.

The backdrop: Ross has recently changed his explanation for adding the question. He initially told a congressional committee that he had only talked with officials at the DOJ to determine the question's legality, but he recently said that Steve Bannon, President Trump’s former chief strategist, also played a role in his decision.

Judicial Watch Sues for Records of FBI 302 Interviews with Demoted Justice Department Official Bruce Ohr

Federal Court Hearing Thursday, September 13, in separate suit – DOJ demands up to 6 months to turn over only 1,650 Pages of Bruce Ohr-Steele-Fusion GPS records

(Washington, DC) – Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit against the Department of Justice for details of the 302 interviews the FBI conducted with Bruce Ohr, who was removed from his position as U.S. Associate Deputy Attorney General in December 2017. The interviews could be key to understanding how anti-Trump dossier author, British spy Christopher Steele’s information was transmitted to the FBI.

Judicial Watch sued (Judicial Watch v U.S. Department of Justice (No. 1:18-cv-02107)) after the Justice Department failed to respond to a FOIA request seeking Form 302s for a number of interviews with Ohr concerning his interactions with Steele. A Form 302 is used by FBI agents to summarize the interviews that they conduct and contains information from the notes taken during the interview. Judicial Watch is seeking:

Ohr FD-302 12/19/16 (interview date 11/22/16)

Ohr FD-302 12/19/16 (interview date 12/5/16)

Ohr FD-302 12/19/16 (interview date 12/12/16)

Ohr FD-302 12/27/16 (interview date 12/20/16)

Ohr FD-302 1/27/17 (interview date 1/27/17)

Ohr FD-302 1/31/17 (interview date 1/23/17)

Ohr FD-302 1/27/17 (interview date 1/25/17)

Ohr FD-302 2/8/17 (interview date 2/6/17)

Ohr FD-302 2/15/17 (interview date 2/14/17)

Ohr FD-302 5/10/17 (interview date 5/8/17)

Ohr FD-302 5/12/17 (interview date 5/12/17)

Ohr FD-302 5/16/17 (interview date 5/15/17)

Until his dossier-related demotion, Bruce Ohr was the fourth ranked official at DOJ and a contact for Steele. The House Intelligence Committee memo released by Chairman Devin Nunes on February 2 says that his wife, Nellie Ohr, was “employed by Fusion GPS to assist in the cultivation of opposition research on Trump” and that Bruce Ohr passed the results of that research, which was paid for by the Democratic National Committee (DNC) and the Hillary Clinton campaign, to the FBI.

In August, Judicial Watch released FBI records showing that Steele was cut off as a “Confidential Human Source” after he disclosed his relationship with the FBI to a third party. The documents show at least 11 FBI payments to Steele in 2016 and that he was admonished for unreleased reasons in February 2016.

Emails and memos released to Congress show that Bruce Ohr continued to receive information from Steele in 2017 after the FBI had terminated its relationship with Steele in 2016 for leaking to the media.

In a related case seeking records of communications between Ohr, other DOJ officials and Steele or Fusion GPS, the DOJ told the court it has located 1650 responsive documents and wants until February 2019 to turn them over. A hearing in federal court will be held in that case on Thursday, September 13, 2018, before U.S. District Court Judge Trevor Neil McFadden.

Date: Thursday, September 13, 2018

Time: 10:00 a.m.

Location: Courtroom 2

U.S. District Court for the District of Columbia

333 Constitution Ave NW

Washington, DC 20001

Judicial Watch filed the lawsuit (Judicial Watch v. U.S. Department of Justice (No.1:18-cv-00490)) on March 1, 2018, after the DOJ failed to respond to a December 7, 2017, FOIA request for:

All records of contact or communication, including but not limited to emails, text messages, and instant chats between Bruce Ohr and any of the following individuals/entities: former British intelligence officer Christopher Steele; owner of Fusion GPS Glenn Simpson; and any other employees or representatives of Fusion GPS.

All travel requests, authorizations and expense reports for Bruce Ohr.

All calendar entries for Bruce Ohr.

“Judicial Watch is doing the heavy lifting in federal court against the DOJ’s outrageous delays and secrecy about the Ohr-Strzok-Steele-Fusion GPS-Dossier scheme targeting President Trump,” said Judicial Watch President Tom Fitton. “Once again, it may be Judicial Watch – not Congress – that is finally able to extract the truth about this continuing Deep State scandal.”

BREAKING Explosive Device Found Near George Soros Home

https://www.nytimes.com/2018/10/22/nyregion/george-soros-explosive-device.html

An explosive device was found near the Westchester County home of the billionaire philanthropist George Soros on Monday, a law enforcement official said.

The device did not explode on its own, and bomb squad technicians “proactively detonated” it, the official said.

Federal and state law enforcement officials responded to the scene in Katonah, N.Y., a hamlet in the upscale town of Bedford in northern Westchester.

The Bedford Police Department and the Westchester County Department of Public Safety said Monday night that they were investigating at that location. The police declined to answer questions but said that a hazardous device unit had been requested.
