As long as the perp thinks the evidence is real, the justice system normally treats the use of that (fake) evidence as actual intent whether the perp actually succeeds (he didn't obviously) or not.
attempted murder would be a normal charge in a bomb plot. Doesn't matter if the bombs are full of roses.
