'Migrant Caravan' Members Sue Trump Over 'Shockingly Unconstitutional' Asylum Crackdown

 

President Trump's rhetoric about the organized 'caravans' of migrants plodding toward the US border has been nothing short of incendiary, as the president has threatened to send as many as 15,000 troops to the border to stop the mobs of "dangerous people" from entering the country. Among other claims, Trump hinted that he might ask soldiers to fire on the migrants if they start pelting border agents with rocks, and that he would be building "massive cities of tents" to house the would-be asylum seekers as they await their hearings in an effort to end the "abuse" of the US asylum seekers.

 

Well, apparently these remarks haven't sat well with members of the caravan and their shadowy financial backers, because a group of 12 migrants, six of them children, have filed a lawsuit against Trump, claiming his efforts to beef up security along the border, and threats to deprive them of asylum, represent "shockingly unconstitutional" attacks on their rights, according to Fox News

 

The Fifth Amendment stipulates that "no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law." And ironically, none other than former Supreme Court Justice Antonin Scalia helped cement these protections by ruling in a 1993 case that "it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding."

 

Twelve Honduran nationals, including six children, were named as plaintiffs in the lawsuit, which was filed Thursday in the US District Court in Washington, D.C. The lawsuit alleges that it is widely known that Guatemala, Honduras and El Salvador are enmeshed in an "undergoing a well-documented human rights crisis." Furthermore, the suit claims that Trump cannot stop migrants from entering the US when they have a credible claim of asylum, according to the Washington Examiner.

The lawsuit points to Trump's claim that he will prevent the caravan from entering the U.S. It claims that the president cannot stop asylum-seekers by employing the military - when they have a fair claim. The suit criticized the president's attempt at stoking "fear and hysteria," by claiming that criminals and gang members have joined the caravan.

 

The suit cited a Trump interview with Fox News’ Laura Ingraham, where the president laid out plans to build tent cities to house migrants. The suit questioned the functionality of such a project, and asked if these living quarters would qualify under the Flores Agreement of 1997. The agreement protects asylum-seekers’ rights and limits how long minors can be held.

 

Earlier this summer, a federal judge in California rejected a request by the administration to modify Flores to allow for longer family detention. Administration officials say they have the authority to terminate the agreement, but that is likely to be tested in court.

 

The suit also alleges that the US can't send troops across the US-Mexico border to stop migrants from entering the US. It also argues that Trump can't demand that asylum seekers present themselves at lawful border-crossing points, as US law states that an asylum seeker can declare their intention to seek asylum anywhere (the president said last week that he intends to issue an executive order declaring that asylum seekers declare at lawful border checkpoints).

 

Nexus Services Inc. is funding the lawsuits through a civil rights law firm called Nexus Derechos Humanos (Human Rights) Attorneys Inc.

 

"Federal law enables migrants to apply for asylum in the United States. President Trump and his administration have used ‘increased enforcement,’ like separating families and lengthening detention to violate migrant rights," Mike Donovan, president of Nexus Services, said in the release.

 

There is another legal issue at stake, according to the lawsuit. The U.S. cannot send troops into Mexico to cut off the caravan from crossing the border. Even with the National Guard at the border, once an immigrant indicates an intention to apply for asylum, the process has begun.

 

The White House, Department of Justice and the Department of Homeland Security were all named as defendants in the suit. The lawsuit is seeking an immediate judgment for the plaintiffs and a court declaration that Trump's border plan is unconstitutional.

‘Thanks for putting up with invasion’: Australia’s former PM Abbott greets indigenous people

 

Former prime minister of Australia Tony Abbott is being criticized for a tactless greeting in which he thanked indigenous people for “putting up with the invasion.”

 

The Liberal Party politician once provoked outrage in a keynote speech when he said that Australia was “unsettled” before Britain colonized the land. Now it appears he’s put his foot in it again by greeting ancestors of people who were effectively colonized with the word “invasion”.

 

The former leader made the ill-judged comments while on a three-day visit to meet with aboriginal communities in Pukatja, according to Australia’s SBS News. Video footage of the moment shows the politician meeting people in a classroom. “Thank you for putting up with the invasion,” he can be heard to say.

October Surprise: U.S. Added More Than 1,000 Manufacturing Jobs a Day, Best Since 1998

 

Rumors of a slowdown in American manufacturing were greatly exaggerated.

 

The United States added 32,000 new manufacturing jobs in October, more than 1,000 every day, including holidays and weekends. Twenty-one thousand of the new manufacturing goods were in durable goods manufacturing, including more than 10 thousand in transportation manufacturing. More than 6,000 new jobs were added in autos and auto parts. Nearly 5,000 jobs were added by makers of machinery.

 

October is not typically a strong month for manufacturing jobs. In fact, the U.S. has not created this many manufacturing jobs in October since 1998, according to Department of Labor data. Manufacturing was expected to grow by just 13,000 jobs.

 

October was a surprisingly strong month for jobs overall, with the economy adding 250,000 jobs. That far exceeded expectations of 190,000.

 

The strong growth of manufacturing comes after widespread predictions that trade disputes and tariffs on metals would weigh on domestic manufacturing. Instead, domestic manufacturing is booming.

 

The job growth in autos and machinery, heavy users of the tariffed steel and aluminum, indicate these have not been hit by the tariffs. Machinery manufacturing employment is up 4.5 percent from a year ago, outpacing the rate of growth for the broader economy. Transportation manufacturing jobs have grown by 3.6 percent.

 

Fabricated metals manufacturing jobs are up 3.6 percent from a year ago. These are perhaps the jobs most directly in the line of fire from metals tariffs. They include toolmaking, hardware making, and architectural and structural materials manufacturing. For the month, however, this category shed 100 jobs, a decline of 0.1 percent, on a seasonally adjusted basis.

 

Although the forecast job losses due to metals tariffs have not occurred, there are signs that U.S. tariffs on China are adding to jobs. The U.S. added 2,200 jobs manufacturing computers and electronics, the first area of Chinese manufacturing hit by tariffs, in October and these are up 2.2 percent from a year ago.

 

Food manufacturing, an area some thought would be hit by retaliatory tariffs, boomed in October, adding 6,800 jobs. These are up 2.1 percent compared with a year ago.

According to HuffPo, a coalition of some of the largest businesses in the world — Google, Coca-Cola, Apple, Amazon, Pepsi, JPMorgan Chase, Dow Chemical, Uber, etc. — have all signed a letter denouncing the Trump DOJ's recent policy of recognizing gender as a "biological, immutable condition determined by genitalia at birth."

The letter makes no reference to President Trump specifically, but it does denounce administrative efforts to curtail transgender language, alleging that it amounts to "erasing" their rights.

 

We, the undersigned businesses, stand with the millions of people in America who identify as transgender, gender non-binary, or intersex, and call for all such people to be treated with the respect and dignity everyone deserves.

 

We oppose any administrative and legislative efforts to erase transgender protections through reinterpretation of existing laws and regulations. We also fundamentally oppose any policy or regulation that violates the privacy rights of those that identify as transgender, gender non-binary, or intersex.

 

The coalition identified themselves as Businesses for Trans Equality. Collectively, they represent more than $2.4 trillion in annual revenue. Non-American companies, including Deutsche Bank and the Royal Bank of Canada, also signed the letter.

 

The letter goes on to call for the government to show "respect and transparency" when creating policies that will give transgenders "full equality under the law." It also notes that "diversity and inclusion are good for business, and that discrimination significantly harms transgender people and imposes productivity costs."

 

"Equality is not a right for some, but for all," Elizabeth Wood, Levi Strauss & Co. Chief Human Resources Officer, said in the letter.

 

"Executive actions and laws that allow discrimination erode our ability to foster vibrant, competitive workforces, which halts growth, creativity, and innovation," she added. "Our workplaces and communities must be diverse and welcoming for all people, regardless of race, sex, national origin, ethnicity, religion, age, disability, sexual orientation or gender identity."

 

The signatures were reportedly secured by the National Center for Transgender Equality, an organization that said the Trump DOJ's policy seeks to erase transgenders from existence.

President Trump is not the only world leader that is rejecting the subjective gender identity movement. Most recently, Australian PM Scott Morrison said he has had enough transgender "nonsense," refusing to capitulate to the movement's demands for the government to create "non-binary" government documents for transgender people.

 

"A Liberal-National Government will never remove gender from birth certificates, licenses and passports – who are Labor kidding? Get real," said Morison on Twitter. "This is the problem with Labor, obsessed with nonsense like removing gender from birth certificates rather than lower electricity prices, reducing tax for hard-working families and small businesses."

DHS: 300 in Migrant Caravans Are Known Convicts, Gang Members

 

Department of Homeland Security officials report that nearly 300 members of the migrant caravans en route to the U.S. at this time are either convicted criminals or known gang members. The criminals include individuals with convictions for sexual assault on a child, aggravated assault with a deadly weapon, armed robbery, and assault on a female, officials reported.

 

In an effort to lay out the facts about the migrant caravans approaching the U.S. from Central America, DHS officials reported that more than 270 people traveling along the caravan route have criminal histories or are known to be members of violent gangs.

 

DHS officials stated:

 

We continue to be concerned about individuals along the caravan route. In fact, over 270 individuals along the caravan route have criminal histories, including known gang membership. Those include a number of violent criminals – examples include aggravated assault with a deadly weapon, armed robbery, sexual assault on a child, and assault on a female. Mexican officials have also publicly stated that criminal groups have infiltrated the caravan. We also continue to see individuals from over 20 countries in this flow from countries such as Somalia, India, Haiti, Afghanistan, and Bangladesh. There is a large segment of this population that we know nothing about and we must be prepared to defend our border and enforce our laws to protect the citizens of our country.

 

The Mexican ambassador to the United States described some of the caravan migrants as “very violent,” DHS officials stated. “Unfortunately, some of the people in the caravan have been very violent against authority, even though they have offered the possibility of entering in compliance with immigration law and refugee status,” the ambassador said.

 

During a radio interview, Mexico’s Interior Minister Navarrete Prida confirmed that criminal groups and gangs have infiltrated the migrant caravans.

 

“I have videos from Guatemala that show men dressed in identical clothing, sporting the same haircuts, handing out money to women to persuade them to move to the front of the caravan,” Prida said. “We know, for a fact, that some members of the caravan threatened [Mexican] Migration Institute personnel and we have images showing many of them preparing Molotov cocktails.”

 

DHS officials also said the migrant caravans are about 50 percent male. The interior minister for Guatemala said the caravan organizers are pushing women and children to the front of the groups to act as human shields when the caravans approach military or police.

 

Officials expect members of the caravan could reach the U.S. border with four days or up to two weeks depending on how transportation becomes available for the migrants.

 

DHS officials stated they intend to enforce existing immigration and asylum rules and laws. They stated that individuals who are seeking family reunification or jobs are not eligible to qualify for asylum.

Rep Louie Gohmert Doubles-Down After Ending Dobbs Segment With ‘It’s Not Anti-Semitic To Criticize [George] Soros’

 

Texas Rep. Louie Gohmert fired back at those who accuse him and others of anti-Semitism for criticizing liberal billionaire financier George Soros.

 

At the end of a segment on Wednesday night’s “Lou Dobbs Tonight,” Gohmert said, “It’s not anti-Semitic to criticize Soros, and Israel issued a statement a year ago saying just that.”

 

Gohmert’s televised comments came less than a week after Judicial Watch’s Chris Farrell was banned from Fox-affiliated networks after accusing the “Soros-occupied State Department” of funding the caravan of migrants on its way through Mexico to the United States, a claim that the Texas congressman himself has echoed.

 

The left has made a concerted attempt to link any criticism of the billionaire financier with anti-Semitism. In an article titled, “‘Dripping with poison of antisemitism’: the demonization of George Soros,” The Guardian’s Jason Wilson makes his case:

He has been falsely accused by the right of orchestrating alleged violence from so-called “antifa” groups, manipulating the world economy, being a wartime Nazi collaborator and sponsoring the entirely fictional project of “white genocide.”

 

As does Democratic Rep. Adam Schiff, who told CNN’s Jake Tapper on Sunday that attempts to link Soros to the caravan is akin to a “blood libel” against Jews.

 

In a statement to The Daily Caller, Rep. Gohmert doubled-down on his criticism of Soros:

 

“The alt-left media, including the New York Times, has decided to provide an all out defense of their beloved, self-identified and remorseless former Nazi collaborator of Jewish lineage, who even the Israeli government knows well is not their friend. George Soros, an anti-God, anti-Israel billionaire, is perhaps the largest ever global funder of efforts to undermine America’s Constitution. Anyone who puts this much effort into the destabilization of America and the destruction of Israel deserves to be called out for his actions.”

 

The Texas congressman also included a link to a statement from Israel’s Ministry of Foreign Affairs that essentially accused the billionaire financier of undermining “Israel’s democratically elected governments by funding organizations that defame the Jewish state and seek to deny it the right to defend itself.”

Marriage Up, Abortion and Divorce Down as Hungary Chooses Family Support Over Mass Migration

 

Hungary is preparing to hold a country-wide national consultation on its family policy, which has already resulted in an increase in marriage and a decline in abortion and divorce.

 

The Fidesz-KDNP government has chosen to support couples with children rather than accept mass migration to ameliorate long-term demographic issues, to the chagrin of its critics in the European Union’s power elite.

 

“In recent years, finding the proper response to Europe’s demographic decline has become one of the biggest sources of disagreement between European and Hungarian politics,” observed Dr Zoltán Kovács, official spokesman for Prime Minister Viktor Orbán’s Cabinet Office, in a post on the official About Hungary website announcing the upcoming national consultation.

 

“While Brussels bureaucrats and the European liberal, pro-migration mainstream see immigration as the necessary and unavoidable solution, the Hungarian government stands committed to the idea of increasing birth rate through more effective family support measures,” the Hungarian added.

 

Dr Kovács claimed existing pro-family policies implemented by the Orbán government are already bearing fruit, with abortion number dropping by more than a third from 40,449 to 28,500 from 2010 to 2017, divorces falling from 23,873 in 2010 to 18,600, and — perhaps most remarkably — marriages increasing by a striking 42 percent.

 

Hungary’s results in reducing abortion, in particular, have earned widespread praise from pro-life organisations overseas.

 

The country’s new constitution makes a commitment to protect the unborn, but abortion on demand up to 12 weeks remains legal, and up to 24 weeks in the case of severe disability, according to the Christian Institute.

 

It appears to be extra government support for adoption services and counselling for expectant mothers which has brought the number of abortions down, along with a requirement for a three-day waiting period between an abortion request and termination, to make sure women have time to reflect on their decision and cannot easily be rushed by third parties.

 

The European Union often attempts to interfere with family policy in Hungary, with the bloc’s unelected governing executive weighing to denounce a pro-adoption poster campaign showing an unborn baby in its mother’s womb with the slogan ‘I understand that you are not yet ready for me, but give me up to the adoption agency, LET ME LIVE!’ as being “against European values”.

Corrupt Foreign Officials Directing British Foreign Aid to Organised Crime Syndicates

 

Millions of pounds’ worth of British international aid is being appropriated for organised criminals by corrupt foreign officials, according to reports.

 

The revelations come as the National Crime Agency (NCA) — devised as Britain’s answer to America’s Federal Bureau of Investigation (FBI) — and the Home Office under Sajid Javid unveil their National Strategic Assessment of Serious Organised Crime and their long-term plan to tackle it, respectively.

 

“Serious and organised crime is the most deadly national security threat faced by the UK, and persistently erodes our economy and our communities,” Javid declared in his foreword to his new strategy document.

 

“Serious and organised criminals operating in the UK sexually exploit children and ruthlessly target the most vulnerable, ruining lives and blighting communities,” he added, admitting that the criminals’ activities “cost us at least £37 billion each year.”

 

Turning to the global nature of the “criminal web” the United Kingdom has become ensnared in, Javid described a “direct link between the drugs being sold on our streets, including the violence linked to that trade, the networks trafficking vulnerable children and adults into the UK and corrupt politicians and state officials overseas who provide services and safe haven for international criminal networks.”

 

According to the Daily Mail, one of the ways Britain has been targetted is through its exorbitant and controversial foreign aid budget, which sees Britain splurge around £14 billion a year around the world despite significant cutbacks to public services at home and a need for investment in Brexit preparedness.

 

The newspaper revealed that the NCA is currently conducting a “number” of investigations into what it described as “cash being stolen or even handed to crime syndicates in poverty-stricken countries by their own corrupt regimes.”

 

“Criminals are continuing to develop international connections to increase the reach of their activity, and to maximise profits,” commented NCA Director-General Lynne Owens

 

“We are also seeing ever-increasing crossover between crime threats, with finance at the heart of this. Organised criminals involved in smuggling of people or firearms also supply drugs, and the relationship between organised immigration crime and modern slavery is becoming more apparent.
