White nationalist leader posts photos at White House

The leader of white supremacist group Identity Evropa visited the White House on Wednesday, claiming on Twitter that he stopped by in order to "pay [his] respects."

 

Patrick Casey, whose group participated in the deadly 2017 white nationalist rally in Charlottesville, Va., posted the photos of himself at the White House on social media.

 

The White House, in a statement to The Hill, claimed Casey was one of thousands of people who visited the White House on Wednesday for the White House Fall Garden Tour, which took place on Oct. 20 and 21.

 

Casey, however, posted the photos in a tweet on Wednesday.

 

"[Casey] was one of more than twenty-five thousand people who came to the White House Fall Garden Tour, which is open to the public," White House press secretary Sarah Huckabee Sanders said in a statement. "Free tickets are made available to anyone who wants to attend."

 

In a later tweet, Casey echoed the White House response, stating that he visited during a tour. However, he did not clarify when the tour took place.

"I attended the White House during a tour, for which tickets are freely available to the public," Casey tweeted Wednesday evening. "I would, though, like to thank @jaredlholt, @JGreenblattADL, @jaketapper, and every other guillible, histrionic loser for the free advertising!"

The White House Fall Garden Tour took place last month. Passes were doled out by the National Park Service on a first come, first served basis each morning of the tours.

 

Casey's group, Identity Evropa, popularized the motto "you will not replace us," a reference to the conspiracy that nonwhite groups are seeking to eliminate the white population. Protesters in Charlottesville chanted the slogan, as well as "Jews will not replace us."

 

Trump met with another prominent right-wing figure under unclear circumstances in August.

 

According to photos posted online, Trump met with "QAnon" conspiracy theorist Lionel Lebron in the Oval Office.

 

Sanders at the time said in a statement that Lebron was part of "a large group came through the White House for a brief tour and a photo," though White House officials told the Daily Beast that Lebron would have required a staffer to vouch for him in order to gain close proximity to the president.

Bush's Suspension of Habeas Corpus

President Bush suspended writs of habeas corpus through his support and signing into law of the Military Commissions Act of 2006. The bill grants the President of the United States almost unlimited authority in establishing and conducting military commissions to try persons held by the U.S. and considered to be "unlawful enemy combatants" in the Global War on Terrorism. In addition, the Act suspends the right of "unlawful enemy combatants" to present or to have presented in their behalf, writs of habeas corpus.

 

Specifically, the Act states, "No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination."

 

Importantly, the Military Commissions Act does not affect the hundreds of writs of habeas corpus already filed in federal civilian courts on behalf of persons held by the U.S.as unlawful enemy combatants.

 

The Act only suspends the accused person's right to present writs of habeas corpus until after their trial before the military commission has been completed. As explained in a White House Fact Sheet on the Act, "… our courts should not be misused to hear all manner of other challenges by terrorists lawfully held as enemy combatants in wartime."

Military Commissions Act of 2006 - (Sec. 2) States that the authority under this Act to establish military commissions (commissions) may not be construed to alter or limit the the President's authority under the Constitution or laws of the United States to establish commissions for areas declared to be under martial law or in occupied territories should circumstances so require.

 

(Sec. 3) Amends the Uniform Code of Military Justice (UCMJ) to codify and establish procedures governing the use of commissions to try alien unlawful enemy combatants (combatants) engaged in hostilities against the United States for violations of the law of war and other offenses specifically made triable by commissions under this Act. Defines an "unlawful enemy combatant" as a person who has: (1) engaged in or supported hostilities against the United States or its co-belligerents who is not a lawful enemy combatant; or (2) been determined to be an unlawful enemy combatant by a Combatant Status Review Tribunal or other tribunal established under the authority of the President or the Secretary of Defense (Secretary). Defines a "lawful enemy combatant" as a person who is a member of: (1) the regular forces of a State party engaged in hostilities against the United States; (2) a militia, volunteer corps, or organized resistance movement belonging to a State party engaged in such hostilities, which are under responsible command, wear a fixed distinctive sign recognizable at a distance, carry their arms openly, and abide by the law of war; or (3) a regular armed force who professes allegiance to a government engaged in such hostilities, but not recognized by the United States.
