THIS IS WRONG and not only that is harmful to the PLAN - and also NOT proper originalist construction - Article I Section 9 of the US Consitution exoressly provides that:

"The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."

Where does it say Congress anons? NO WHERE - so where does this idea come from? ACB claims is comes from english common law but that is WRONG - it comes from English STATUTES - the common law permitted the Monarch (executive) to suspend in times of rebellion.

There were fights over this power and court jurisdiction bith in england and here in the USA and the matter is complex and really chaotic - But SCOTUS has NEVER held that POTUS has to get congress to approve suspension in times of rebellion - NEVER

This is a KEY issue for SCOTUS going forward with military tribunals - another reason why ABC will NEVER be nominated for SCOTUS (see priro opinion piece i posted below)
