The Smith Mundt Modernization Act disapplied the former restrictions on the use of propaganda against the American People. It's arguable that what we're seeing now is NOT action by the US Government, but a run on of the status quo established during the second Obama Administration.

 

The behavior of the media does not, to the extent that it is independent of the US Government (which appears to be the case), fall under the SMMA.

 

General regulation of the media under other statutes, (and claims that might be prosecuted under anti-trust legislation if anyone has the balls to pursue the matter), would normally apply.

I should have mentioned that the position is potentially more complex, insofar as agencies of the US Government might be leading media actions outside "official" policy directives. But that would apply to all actions of the Deep State, and the point might never be tested in court, for obvious reasons.
