Way some states get around this is to force citizens to pay for surveys themselves if they want to do anything in those areas, including digging a 3 foot long ditch.

The Endangered Species Act is a giant clusterfk as well. Possible jail time for "disturbing habitats", including driving an ATV or farm vehicle on anything they may deem as "habitat".

 

If you look at the habitat for "bog turtles" for example, you'll see that basically means anything within 300 feet of a stream bed + vernal pool areas + more.
