Democrat Kyrsten Sinema Slated For Victory As Vote Count Heads In Her Direction

 

The prolonged Arizona Senate election is Democratic Rep. Kyrsten Sinema’s to lose as incoming mail-in ballots continue to trend in her direction. Following a dump of new mail-in ballots Sunday, Sinema expanded her lead over GOP Rep. Martha McSally — with Sinema now leading by 32,292 votes, or 1.5 percentage-points. Her campaign is declaring it would be impossible at this point for McSally to swing the election. “With the latest ballot count, Kyrsten’s lead is insurmountable,” Andrew Piatt, Sinema’s campaign manager, said in a statement. “McSally’s campaign said today’s results would be her ‘firewall’ but as we expected, no firewall emerged… Kyrsten will be declared the next U.S. Senator from Arizona.”

 

However, McSally’s camp is holding out hope, pointing out that thousands more ballots remain to be counted. There are estimated to be well over 200,000 votes left to tally. Arizona — a state where 75 percent of votes are cast by mail-in ballot — traditionally witnesses slow-paced election results. “We believe every single lawful vote should be counted, including those from rural areas. The Democrats’ legal strategy is clear as it is troubling. They want to disenfranchise eleven counties they can’t win,” said Arizona GOP state chair Jonathan Lines ahead of a court hearing Friday.

 

Arizona Republicans had filed a lawsuit over the state’s election process, alleging that county recorders were not following uniform process when verifying mail-in ballots. Parties involved in the lawsuit were able to reach a settlement Friday, allowing voters to verify their signatures by 5 p.m. on Nov. 14. While there are thousands of votes left to be counted, with the potential of swaying the election in McSally’s favor, the uncounted precincts are heavily centered in Democratic-leaning areas. The Arizona Republic estimates that the Republican candidate would need to win the remaining votes by a 15-point margin in order to tie the race. Uncounted ballots are in Pima, Coconino, Maricopa and Pinal counties. Sinema is winning in all of these counties except Pinal. “McSally would have to win the remainder of Maricopa County ballots by 22 percent to take the lead in this race. This is not plausible,” Piatt stated Sunday.

 

The election forecasting website Cook Political Report has projected Sinema to win the election. As of Monday morning, no other major network has officially called the race. McSally and Sinema are running to replace outgoing Republican Sen. Jeff Flake, who announced in October 2017 that he would not run for re-election.

City of San Francisco threatens court action over Trump's acting Attorney General

 

San Francisco’s city attorney on Monday questioned the recent appointment of a new acting attorney general, saying in a letter to the U.S. Department of Justice that his office may take court action if the DOJ does not provide a legal justification for the designation. President Donald Trump last week named Matthew Whitaker to replace former Attorney General Jeff Sessions, who was forced out after months of attacks by Trump for recusing himself from an ongoing probe into Russian meddling in the 2016 presidential election. The move made Whitaker supervisor of the investigation, which has hung over Trump’s presidency. Whitaker has criticized the probe in the past as too wide-ranging, which has raised concerns among Democrats that Sessions’ ouster and Whitaker’s appointment might be precursors to Trump moving to end it.

 

In the letter on Monday, San Francisco City Attorney Dennis Herrera said the city currently has four cases proceeding in court that name Sessions as a defendant. One of those cases led to an injunction blocking a Trump executive order over sanctuary cities. Given that the Sessions resignation impacts those cases, Herrera said DOJ should provide legal justification for the Whitaker appointment. Otherwise, the city “may be forced” ask a judge for it, the letter said.

 

A Justice Department spokesperson could not immediately be reached for comment. Sources told Reuters last week that Senate Democrats were considering suing Trump on the grounds that, in naming Whitaker, the president ignored a statutory line of succession at the Justice Department and deprived senators of their constitutional “advice and consent” role on some presidential appointments. Herrera’s letter also questioned Whitaker’s appointment because he had not been confirmed by the U.S. Senate.
