Do a search for Posse Comitatus and the Insurrection Act. They were covered here in some detail about a week ago. There is NO legal interference keeping the troops from defending the border. If there was, that would make ours the only border in the world where they are so hindered. Defense of the borders and ports is one of the very few Constitutionally MANDATED functions of the government and no law preventing such is, in fact, a law at all.
