Avenatti allegedly said "she hit me first…this is bullshit…this is f*cking bullshit."

 

The defendant's statements are admissible at trial (he'll fight it, but it's well-accepted law).

 

It appears Avenatti is setting the stage for self-defense. He's likely hoping that the case comes down to a credibility play between himself and the alleged victim. HOWEVER, self-defense must be reasonable and proportionate, a question the jury will have to decide.

 

Is LA corrupt enough to plea the case down from felony to misdemeanor or a suspended sentence? Probably, but he's toast in that scenario.

 

Is he ballsy enough to try the case? Dunno, he may not have anything to lose. IMO, he'l likely continue the case until everyone forgets about it & either get a sweetheart deal or try the case.

 

Barring a credible retraction by the victim or exculpatory evidence, CPL is done.
