Watched an MSM cover on this earlier sounded very much like a CYA situation ("um, yeah, we did look into it, but he had freedom of speech so..."). Wouldn't be far-fetched to say that they used their usual entrapment if not to have him actually carry out the act, to make sure that he could be the patsy once it was committed.
