>I don't think the Judicial Branch has the power to throw out the charges….the discretion to bring charges is up to the Executive Branch and then the trial moves forward. The trial determines if there is evidence to convict.

Last Bread discussing the abuse of power by the Judge that threw out the Female Genital Mutilation charges in the 6th Circuit because he decided on his own that the Congressional Act banning FGM was Unconstitutional…

In my research I found that this is actually abuse of power by the Judicial Branch and they are essentially claiming Supremacy over the other 2 branches of government

Furthermore, it is also a SEPARATION OF POWERS issue since the EXECUTIVE BRANCH has exclusive power/discretion to bring charges and dismiss charges against a Defendant.

Here is an interesting article on this subject:

WHY WOULD CRIMINAL CHARGES BE DROPPED OR DISMISSED?

https://www.yourphiladelphialawyers.com/criminal-charges-dropped-dismissed/

"There are a number of different reasons why criminal charges may be dropped or dismissed, but first you need to know the difference between the two, and when each happens. "

1. CHARGES DROPPED

Only the prosecutor or the arresting officer is able to drop charges.

<REASONS:

-victim no longer is willing to cooperate it becomes much more difficult for a prosecutor to prove their case

-insufficient evidence

-new evidence or testimony that contradicts the original arrest information

-evidence being deemed inadmissible

-evidence that the defendant’s constitutional rights have been violated

2. CHARGES DISMISSED

By contrast, having charges against a person dismissed is something that can be done by either the prosecutor or a judge, but it can only be done after the case has already been filed.

<REASONS:

Usually insufficient evidence

I DON'T SEE ANYWHERE THAT A JUDGE CAN DECLARE THE CONGRESSIONAL ACT THAT THE CHARGES FALL UNDER AS UNCONSTITUTIONAL AND DISMISS CHARGES

SO WE HAVE SEPARATION OF POWERS VIOLATIONS AND ABUSE OF POWER WITH THIS DECISION IN THE 6TH CIRCUIT THAT CONGRESSIONAL ACT BANNING FGM IS UNCONSTITUTIONAL

Brings Q's post into light….

How do you ensure those prosecuted [non military] would receive an impartial judgement based on the RULE OF LAW?

Think Federal Judge rulings [obstruction] [POTUS’ granted CONSTITUTIONAL authority].

How do you ensure 'appeals' to the U.S. Supreme Court are evaluated impartially based on the RULE OF LAW?

Think Justice K (5 to 4).

>Now as Q. Nameless faceless. The old school Jew tactics taught by Saul Alinsky fail.

Very True! I keep thinking about the parallels with the Federalist and Anti-Federalist papers as well. They were all signed anonymously at the time and maybe for some of the same reasons.

>They lie about wars. Why wouldn't they lie about PACER? That's the one area we can trust?

The filing of a case is most likely reliable even if the rest of the PACER record isn't. Why lie about the filing of a case and assigning a case #?

>SecureDrop was one. It's possible Wikileaks was another, in selected circumstances.

Agreed…

Another I suspect as a 'whistleblower trap' is Global Witness where Alexander Soros is on Advisory Board.

60 Minutes did a special on money laundering and the undercover work Global Witness did:

https://www.globalwitness.org/shadyinc/

Seeing who is on Global Witness Board

SOROS

I'd never give them any information if I was a whistleblower!!!

What a great trap!
