On the subject of secret pardons… CHECK THIS OUT!

Lawfags- I’m interpreting this as Congress has the power to reverse a pardon!

 

Congress and Amnesty

 

Congress cannot limit the effects of a presidential amnesty. Thus the act of July 12, 1870, making proof of loyalty necessary to recover property abandoned and sold by the Government during the Civil War, notwithstanding any executive proclamation, pardon, amnesty, or other act of condonation or oblivion, was pro nounced void. Said Chief Justice Chase for the majority: [T]he legislature cannot change the effect of such a pardon any more than the executive can change a law. Yet this is attempted by the provision under consideration. The Court is required to receive special pardons as evidence of guilt and to treat them as null and void. It is required to disregard pardons granted by proclamation on condition, though the condition has been fulfilled, and to deny them their legal effect. This certainly impairs the executive authority and directs the Court to be instrumental to that end. 253 On the other hand, Congress itself, under the necessary and proper clause, may enact amnesty laws remitting penalties incurred under the national statutes. 254

The cases were cited on the link. Nothing for this new situation. If martial law IS declared and those are arrested, it could present a huge case for the Supreme Court in terms of reversing the pardon. It is all based on CASES, NOT one anything like the current situation, meaning that reversing a pardon COULD be on the table and very disputable since they have a window to go after assets. It is a grey area. And there are zero cases cited that are similar in nature to what has occurred. This is HUGE!

But if the President who does the pardoning is also complicit in illegal activity, we have a case to fight. This has not happened in history, so no case exists is my point. Hussein is complicit in the SAME ACT that he would have secretly pardoned others for.

Correct. Hence the pardon is null and void if the person is implicated.

This would have to go to the Supreme Court to determine the constitutional aspect of the case. I see now why Kav was so opposed. They know Hussein was the leader.
