Judge uses a procedural error to "expressly vacate" the pre-2015 WOTUS rule. That does seem to be beyond his jurisdiction.

 

The EPA can ignore it and fix the procedural error by also taking comments on the pre-2015 WOTUS rule. The judge is supposed to do the least damage, not the most.

 

As long as the government pretends the judge made a more limited ruling, but acts reasonably to address the underlying substance, I would expect SCOTUS to have no problem upholding Trump.

 

These judges are looking for any excuse to make a ruling, then doing maximum damage with those rulings. They're pretty clever, and eventually we may just have to ignore them during the appeals process.
