so one can fairly DEDUCE your point as rational but it does not make it so - particularly when 53-47 was reposted at a time when the final senate count was NOT certain or known

cases from there go to appeals courts that do NOT conduct trials

SCOTUS hears appeals from the inferior appeals courts - they also do not conduct trials except in special cases specified in the consitution
