I don't think that's the idea. I suspect they are trying to give Mueller an excuse to prolong his investigation. They know, as does Mueller, that as soon as he presents his final report the hammer will come down. The only reason it hasn't yet is to not create the appearance of an attempt to interfere with his investigation.
