And people should. I would definatel talk to a lawyer in your state first about how exactly to set up, if you want to do this. Compliance with exact state laws is necessary. That being said… the lawyer will tell you how to go about it, and I am betting smartest way???

Last I read, Secret recording in most states is legal for the purpose of making notes about the conversation. The notes can be entered in court. Usually the only time the recordings are admitted is if the other party calls your notes inaccurate, at which point you can use recording to prove they are not inaccurate.
That is how it was back when I was young, and probably has not changed much.
Our law professor said that the reason was that the party in question had already implicitly stated they were entrusting the information with the second party, since the party in question chose to have the conversation.
Put simply.
A talks to B who secretly records A = ok because A is trusting B with the info in the first place.
The trouble starts when A and B are talking and C decides to record them without the knowledge of either.
This is a great win for all of us.
