Howell is a District Court judge (1st level of federal judiciary). The sealed case that shut down the 5th floor of the D.C. Circuit Court of Appeals (2nd level of federal judicial system) yesterday was an APPEAL that arose in a district court case. We think it arose in a grand jury proceeding. Therefore it may be an argument over evidence and whether the evidence can be shown to the grand jury or not. It must necessarily be an argument between the prosecutors who want to use the evidence, and whoever has the evidence and argues against it being used. Might be oral testimony where someone refuses to testify before the grand jury, might be documentary evidence where the custodian of the evidence refuses to produce it. My speculations.
