Actually Malicious Prosecution lawsuits in the civil arena would require a FAVORABLE DISPOSITION OF HIS CASE.

He was likely advised by his attorneys to not risk jail time when he has a prosecutor who requests no jail time. Not to mention OTHER CHARGES.

Flynn is facing charges that carry serious time. Why risk it when you are getting off with a max of 6 months that he's not going to get?

I'd be a little worried about the Judge today that was off the rails but in all fairness - he's facing 10 or 20 if he goes to trial that's why he's not withdrawing his plea in my opinion.
