Yes. It took allot of research. Never talk to them on the phone. Always write. I have begged ED to bring me to court in writing. They won't do it. Because if they did…they know that it will set precedent if a judge throws it out. They do not want any disruptions in their scam.

Yes. Additionally if the CFPB and the State AG comes knocking and snooping into the collection records the collection agencies freak…and stutter.

 

My case is simple old "FFEL" loans. There is no loan amount ; interest rate or signature of lending officer on the promissory notes. OOOPS.

 

This is why Obama made everything go through ED "Direct Loans" …and cut out all the fingers in the pot. KEK Fuck 'em.

Yes. and thank you for the form letters I'm sure my research came across them and I used some of the wording, then customized it depending on what state I was in at the time.

Start with the Higher Education Act. LEARN IT

 

Then use this against them. Its still good even in 2018.

 

Learn the collection laws in your state. Hold them accountable.

Your Welcome . Make sure you download that PDF. Its being scrubbed. It's their rules…they don't want you to know. Time is important. You get a letter from a collection agency..respond immediately. They have to validate in a timely fashion and with correct documents. ALL the correct documents. When the don't . either time or docs:…send another letter informing them that they have not complied.

Yes. But they are held accountable under the FDCPA. And if they don't follow the law then you hold them accountable. Many do not follow the law. When word gets out across collection agencies that you know what your requiring of them…they will slowly stop bugging you. Don't answer a call from them. Make them write a letter.

ED hold the debt..but they cannot collect on it so they contract a collection agency. Ed will not sell your debt. You will be held to it, but collection agencies break laws all the time. This will free you from their wrath.
