You have to be able to use the facts legally and build up your case THEN…
You go to war as you've already won.
Starts with intel, Rogers & "we have it all". Then it goes to legal to build the cases. One the legal tasks are complete it can go to action/war.
Issue was getting the intel/evidence into the justice system(s). That's what Sessions, Muller (and Flynn?) were/are doing. Preparing and taking in the evidence in a manner that could be used within the existing system of laws by good actors to prosecute the bad ones. Also guessing Q's take is using the existing system is preferable to not using it (i.e. it was good that we were able to avoid [z]).
