Roberts probably is comped, but a stay just puts everything on hold while so parties can argue their case, presumably to the full Supreme Court, are as many of them as can show up.
if Roberts tossed the thing outright, it would have showed everyone how comped he is. by having the Supremes hear it en banc, and the subpoena is upheld, he can shrug and tell his DS handler "hey, I tried."
