As for SCOTUS and your idea, I see the merit, but also see the gigantic charlie foxtrot it would become. It's already a cluster and this actually works somewhat and has for a couple centuries…I'm good with the status quo on picking…just finally got a non-comped picker. Let's pray he picks some good ones with lots of staying power.
I hear you on studying the court more than the Constitution…I used to have to carry a binder with circuit court decisions and legal advisor opinions to supplement the clear state and federal constitutions which I pretty much knew by heart. But since I was personally liable for my actions and those of the officers under me, I took the prudent road and suffered as a caselawfagging police exec.
