The laws or prior court holdings are only as good as the Judge.
And this wouldn't start in the Supreme Court. If its military, it goes to the military courts and maybe ultimately is appealed to the Supreme Court.
If its a normal prosecution, it would start in a federal district court, be appealed to an appellate court and ultimately the Supreme Court.
Hence why the Senate mattered. Trump stacking district and appellate court judges who are more likely to follow precedent. But there are a lot of ways they could still wiggle out.
Military is MUCH better. But not if its subject to significant challenges and they walk.
