Former Mexican State Attorney General Pleads Guilty to International Narcotics Distribution Conspiracy

Defendant Used His Position as a Law Enforcement Official to Facilitate International Drug Trafficking into the United States

Earlier today at the federal courthouse in Brooklyn, Edgar Veytia, the former Attorney General for the State of Nayarit, Mexico, pleaded guilty before United States District Judge Carol Bagley Amon to one count of international conspiracy to manufacture and distribute heroin, cocaine, methamphetamine and marijuana, in violation of Title 21, United States Code, Sections 963, 960(b)(1)(A), 960(b)(1)(B)(ii), 960(b)(1)(G), 960(b)(1)(H) and 959(d), for his involvement in a 2013 to 2017 scheme to import illegal drugs from Mexico into the United States. When sentenced, Veytia faces up to life in prison.

Downing, Special Agent-in-Charge, Los Angeles Division (DEA), Angel M. Melendez, Special Agent-in-Charge, Homeland Security Investigation, New York (HSI), and Matt DeSarno, Special Agent-in- Charge, Federal Bureau of Investigation, Washington, D.C. Field Office (FBI), announced the guilty plea.

The case was investigated by the DEA, FBI and HSI as part of the Organized Crime Drug Enforcement Task Forces (OCDETF). The OCDETF program is a federal multi-agency, multi-jurisdictional task force that supplies supplemental federal funding to federal and state agencies involved in the identification, investigation and prosecution of major drug trafficking organizations. The principal mission of the OCDETF program is to identify, disrupt and dismantle the most serious drug trafficking, weapons trafficking and money laundering organizations, and those primarily responsible for the nation’s illegal drug supply.

Veytia pleaded guilty to Count One of the Indictment, charging him with an international drug trafficking conspiracy to distribute heroin, cocaine, methamphetamine and marijuana from Mexico into the United States. According to court filings and facts presented during the plea proceeding, from January 2013 until February 2017, Veytia used his official position as State Attorney General to assist and abet drug trafficking organizations operating in the Mexican State of Nayarit in exchange for bribes. Veytia, who was responsible for Mexican state law enforcement authorities charged with investigating crime in Nayarit, used his official position to protect drug trafficking activities related to distribution into and within the United States and obstructed legitimate investigations and prosecutions of drug trafficking members in Mexico, for example by preventing the arrest of drug traffickers or unlawfully releasing those who had been arrested by Mexican law enforcement authorities.

The government’s case is being handled by Assistant United States Attorneys Craig Hereen, Ryan Harris, Alicia Washington and Temidayo Aganga-Williams of the EDNY, together with Deputy Chief of Litigation Amanda Liskamm and Trial Attorneys Jason Ruiz and Anthony Aminoff of the Narcotic and Dangerous Drug Section of the Justice Department’s Criminal Division.

Qualcomm forces Apple to stop selling iPhone 7 and 8 in Germany

A US antitrust lawsuit against Qualcomm over patent licensing starts Friday.

Apple has suffered another blow in its global patent battle with Qualcomm as it was forced to pull older iPhones from its shelves in Germany. Currently the German Apple store offers the iPhone XS and XR but not the iPhone 7 or iPhone 8.

Qualcomm says Apple was forced to pull its older smartphones due to a December 20 patent ruling in Qualcomm's favor.

"The Court found that Apple is infringing Qualcomm’s patented power savings technology used in smartphones," Qualcomm wrote. Qualcomm needed to post a €1.34 billion ($1.53 billion) bond with German courts for the ruling to take effect, which it has now done.

In addition to pulling iPhones from its own physical and virtual shelves in Germany, Apple must also recall iPhones from third-party retailers in Germany, Qualcomm says.

In the past, Apple often used Qualcomm chips in iPhone models. But recently the companies haven't been getting along. Early last year, Apple sued Qualcomm in the United States and in China, accusing the company of extortion and anticompetitive conduct in its negotiations over patent licensing.

Qualcomm fought back. In November, Qualcomm won a patent ruling in China that Qualcomm said barred Apple from selling iPhones nationwide—though Apple claimed a software update would work around Qualcomm's patents.

As relations with Qualcomm cooled, Apple began working with other chipmakers instead, including Intel. In September, Qualcomm sued Apple, claiming that Apple shared proprietary details with Intel about Qualcomm's modem chips.

Meanwhile, Qualcomm is facing off in court Friday against the US Federal Trade Commission, which has accused Qualcomm of abusive licensing of mobile chip patents. If the US government prevails in the case, that would strengthen Apple's hands in negotiations with Qualcomm.

Voter confronts Elizabeth Warren over her DNA test. Warren's response is mind-boggling.

While stumping in Iowa on Saturday, Sen. Elizabeth Warren (D-Mass.), who this week formed an exploratory committee for president, was forced to address the results of her infamous DNA test from last fall when a voter confronted her about her motives behind releasing the test's results.

"Why did you undergo the DNA testing and give Donald Trump more fodder to be a bully?" the voter asked at the Sioux City event.

"I am not a person of color," Warren responded. "I am not a citizen of a tribe. Tribal citizenship is very different from ancestry. Tribes — and only tribes — determine tribal citizenship, and I respect that difference."

Without directly answering the question, Warren transitioned into bashing Trump for "hurling racial insults." It was the first time Warren mentioned Trump by name while stumping in Iowa, and she quickly returned to her campaign message, one that advocates a "level playing field" for all Americans.

Still, Warren claimed she was "genuinely" happy to receive the question about her ancestry.

What did the DNA test results show?

Despite claiming for most of her adult life that she is Native American, DNA test results released last October show that Warren is "between 1/64th and 1/1024th Native American."

"While the vast majority of the individual's ancestry is European, the results strongly support the existence of an unadmixed Native American ancestor in the individual's pedigree, likely in the range of 6-10 generations ago," the results declared.
