The catch is the chief justice position still has to be approved by the Senate, so GWB just made the Roberts appointment for CJ so he wouldn't need another vote, since then he'd have been facing 3 SC votes with Roberts, Alito, and the CJ.

 

Rehnquist needed a vote in 1986 just for the CJ position, even though he was already an associate.
