Theory - Upcoming Actions/events

 

  1. RBG Dies or resigns.

  2. Every liberal head explodes on earth and the screaming begins at the same time.

  3. Signs are made protesting every human possible with a law background that POTUS could nominate.

  4. POTUS nominates Amy for SC - She "breezes" through.

  5. GEOTUS Trump declares SOE for Army Corps of Engineers to build the wall. Sits back while attacks intensify.

  6. CA 9th CC does its usual bullshit and stops it.

  7. Challenge goes all the way to SC - Trump vindicated.

  8. Wall is built while we enjoy copious amounts of popcorn and fresh bread.

  9. Liberal heads continue exploding and more screaming.

  10. Declas - Liberals die of shock - Dem "Politicians" are flat-lining at record rates.

  11. Massive investigation fully public. Whoever is still alive gets perp walked.

  12. GEOTUS reelected. - 2 scoops, 2 genders, 2 terms.

It concludes that while the Suspension Clause does not prohibit Congress from giving the President some responsibility for the suspension decision, it does require Congress to decide the most significant constitutional predicates for itself that an invasion or rebellion has occurred and that protecting the public safety may require the exercise of emergency power. Congress made this determination during the Civil War, but it violated the Suspension Clause in every other case by enacting a suspension statute before an invasion or rebellion actually occurred and in some instances, before one was even on the horizon.
