US COURTS RUN OUT OF FUNDING ON JANUARY 18. According to previous research, individuals can be tried in a military court if the civil courts are closed for 3 days.

This would mean that Military Tribunals could start on January 21, 2019 which coincides with the Lunar Blood moon.

What SC decision opened the door for a sitting President to activate Military Tribunals - what must be showed?

 

In ex parte Milligan (71 US 2 [1866]), SCOTUS ruled it is unconstitutional to try civilians by military tribunals unless there is no civilian court available.

 

Must show that the civil authority cannot operate.

The 3 days may have related to the amount of funding that was available at the time. As the article states, the Courts have been utilizing alternative funding to stay open.
