You're right about the restrictions placed on POTUS by normal civilian law, except they're way further ahead on investigations. I expect the Hussein investigation is complete. NSA can prepare everything ahead of time and then get the warrant to bring in a completed investigation, that is, if they're going that route, but we're talking military tribunals in the Q drops.
I'll add that NSA is interchangeable with DIA, Naval, etc. In the civilian space DOJ gets the warrant and those agencies can then hand over everything ready to go.
