Regarding Article II, Section 3 and the SOTU. I believe POTUS could force the issue based on Constitutionally convening Congress, but that could be a battle due to rules and no precedence specifically relating this power to a SOTU. Remember the 53-47? PDJT could simply do as this President did:

Subsequent messages came shortly after the convening of Congress, fulfilling the intended purpose of the Framers that the occasion was not for pomp but for practical content

 

McConnel does the invite, if a resolution is needed, it should pass and Nan is irrelevant, once again. Nothing says he has to do it from the House.

I’m aware of that. But I’d think that lessons have been learned from the Kennedy administration, and the Reagan one as well. I’m looking at it from a legal standpoint, not operational or situational.

Thanks Baker just wanted to have it in full context. I stumbled on that Barr opinion doing a constitution search. Was a bit odd and unexpected.
