Anyone know the legal mechanics of the furlough / RIF?

 

If this is not a "scripted scenario" then POTUS is venturing into (uncomfortable) murky waters:

 

  • Requiring furloughed employees to work (without pay) is tantamount to obligating that money even though it has not been appropriated – (writing hot checks).

There is no guarantee Congress will ever appropriate those funds (especially if they can use it against POTUS)

 

[IMO: Requiring people to work without pay is a dangerous precedent to set - because liberals could turn that into enslavement/communism in the future]

 

Also, read that according to OMB "emergency furlough" due to lapse of appropriations don't require, nor automatically allow, RIF…OMB would have to put together a comprehensive RIF plan and (many may argue) the 30-day clock wouldn't begin until the RIF plan were announced…so those thinking RIFs are currently underway may be disappointed.
