I'm thinking….how does Country A know what type of a case it is if the case is in the Grand Jury stage? Couldn't it be a whistle blower case? WB cases are filed under seal while being investigated. WB cases are Civil Cases which means Country A does not have immunity.
They define 'Country A' in the petition as this…
"Because of the sealing order in place, we will refer to
Petitioner—a wholly owned agency or instrumentality of a
foreign state—as "Country A." "
