lawfag here with some abortion analysis - anons we all know we must be united - that does not mean we have to agree on everything - but di not fight each other - such is the case with the abortion issue - can we agree on the following:

positions are polarized for or against

some say evil murder - some say necessary reality

the law as it stands now allows most abortions

those who oppose abortion want that law changed

those who support choice do not want that right restricted.

this has been the case for about 40 years now - since Roe v Wade was decided.
OK then - and this is the KEY - we all must admit that Roe v. Wade was wrongly decided - even pro choice lawfags like myself admit that - but WAIT - it was NOT because abortion is wrong - NO NO NO - its was because it was social policy and law making by SCOTUS - and if this is true then this "law" was not properly enacted in our system of constitutional govt.
I believe this is the reason why this is so divisive. It was not decided by a democratic process. That needs to be "undone" somehow. It is no different that SCOTUS interfering in others areas or public life - such as race relations and sexual preference and marraige - and it never solves the problem - in our system problems must be solved by public consensus - NOT judicial fiat. Yes, sometimes matters are in a grey area to be interpreted by courts but this is not one of them - far from it. The court invented a right to get the result they wanted and then crafted a "statutory" framework to enforce it.
How do we get out of this mess? Repeating the process of Roe is NOT then answer pro life anons! But that is the approach taken - pass all manner of state laws, try to pack the court with pro lifers and then force SCOTUS into another social policy decision - that is the same error! And even if this strategy succeeds it will never be successful in healing the division OR in stopping abortions! it will only make life miserable for the "losers" just as the pro lifers are miserable now. That is no way to run America anons!
NO - the answer must come from a comprehensive federal law that is debated by congress and the American people, voted on and then signed by the President - It cannot just be thrown back to the States - that would create another patchwork system of injustice.
But it must expressly OVER RULE Roe as judicial over reach - and replace it with a balanced policy that recognizes the deep concerns of ALL citizens and effects a compromise. Abortion must remain available to American women who want it BUT it also must be strictly circumscribed so among many other considerations:
Tax money is never used for this procedure - directly or indirectly.
That the standard for voluntary procedures must be limited by current best medical knowledge and practices with regard to viability of the fetus
That the physical (not mental) health and life of the mother be protected so that decision is hers.
And so on for the many many aspects of this. I believe if all citizens supported this approach we could have a unified and permanent approach to this serious issue. And in the meantime we could declare a CEASE FIRE on this matter and all that entails - STOP accusing people of MURDER and promoting hatred and calling people evil - esp. here on the board but amongst each other everywhere! Then once the GA has settled and THE PLAN has reached its public stage there can be a peaceful and permanent solution to this vexing problem. A decision by WE THE PEOPLE.
