They cannot be sued for actions taken in their official capacity, but the protection does not exist for actions outside the realm of lawmaking, against a private citizen.

I don't think Barnes would be spouting off unless he had the case law to back him up. Note that he did not specify the case law, why provide ammo to the enemy.

yeppers. our libel laws do suck, especially in the media case. they get to spew propaganda and lies with no recourse right now.
