yes the vote totals show all 9. she would have to conference on cases. If she was not participating in conference then her vote could not count on things such as whether to hear a case. Their clerks write a brief about each request to be heard and the Justices discuss and vote.

they have limits to the role they can play. writing briefs is the limit. They can't convey her vote. That would be fraud. writing a decision that says 5-4 when RBG did not cast her vote is fraud. She must be still alive. I don't believe any of the Justices would commit fraud by acting as if she was alive and allowing a clerk to cast a vote or participate on her behalf in the discussions. Clerks are not invited to the discussions and have no constitutional authority to participate
