Blood Centers of the Pacific

Blood Centers of the Pacific is a community based, nonprofit blood center that collects blood donations and provides safe blood and blood components for transfusion and also related services to more than 40 hospitals in the Bay Area and Northern California.

 

It is tied to Vitalant Research Institute

Founded in 1943, Vitalant is one of the nation’s oldest and largest nonprofit transfusion medicine organizations. We comprise a network of more than 125 community blood centers, each with its own rich history and legacy. Vitalant provides blood and special services to patients in more than 1,000 hospitals across 40 states.

 

Today, Vitalant is an internationally known and respected leader that continues to push the boundaries to advance the experience, practice and application of transfusion medicine.

The Research Institute is housed within Blood Centers of the Pacific in San Francisco, CA. Our Research Institute has state-of-the-art equipment to support research related to blood and blood product safety in the areas of molecular biology, immunology, virology, tissue culture, cell processing and epidemiology. Staff have 9000 sq. ft. of labs (including a biosafety level 3 lab), and a 2200 sq. ft. freezer room with capacity to store more than one million specimens.

Appellant Irwin initiated this action in the lower court pursuant to the provisions of the Freedom of Information Act, 5 U.S.C. § 552. It sought an order requiring disclosure by appellee Red Cross of certain financial information. Red Cross defended by asserting that it was not an "agency" of the Federal Government within the meaning of the FOIA. The controlling facts were not disputed, and cross-motions for summary judgment were made. Finding that Red Cross was not an "agency" as defined by 5 U.S.C. § 552(e), summary judgment was granted in favor of Red Cross, from which Irwin appeals. We affirm the lower court's decision.

In February of 1983, at the age of three weeks, Michael Osborn contracted the AIDS virus from a blood transfusion in the course of surgery on his heart at the University of California at San Francisco Medical Center.   The blood used in the operation was supplied by the Irwin Memorial Blood Bank.   Michael and his parents, Paul and Mary Osborn, sued Irwin and the University for damages on various theories.   The only causes of action that survived defense motions for nonsuit and directed verdict were claims against Irwin for negligence, and intentional and negligent misrepresentation.   After the jury returned a general verdict for plaintiffs, the court granted Irwin's motion for judgment notwithstanding the verdict on the intentional misrepresentation and negligence claims.   Irwin was thus held liable only for a negligent misrepresentation.
