The posted speed limit is a guide. While you can always get a ticket if you drive over the posted speed limit, in some cases, you may also get a ticket if you are driving below the posted speed limit if your behavior or actions are considered to be unsafe. All drivers have a duty when on the road to exercise care, and if they violate that duty and go an unsafe speed based on the conditions at the time, they can be ticketed for that activity.
Examples of situations where you might be given a ticket even if you are driving the posted speed limit include:
When there are severe weather conditions. If it is raining or snowing very hard and the roads are icy or your vision is impaired, you may be expected to slow down. If you don't and an officer believes you are moving faster than is safe in light of the conditions, you can be ticketed for going at an unsafe speed.
When there was an accident or some other obstacle hindering a roadway and you drive too quickly based on the obstacles in your path, this can be considered an example of going an unsafe speed.
As a general matter, if a reasonably careful and prudent driver would not be driving at the speed you are going, you can technically be given a ticket for driving at an unsafe speed.
Of course, this can be somewhat subjective. This means if you were given a traffic citation for driving at an unsafe speed that you did not believe was proper, you should strongly consider speaking with an experienced traffic attorney to defend you against the ticket.
