Actually, there is a detail that isn't talked about much having to do with faking video. Many of the video cameras on the market emit video in a lossless compression format that is incredibly difficult (if not impossible) to emit without the code from the manufacturer of the video camera. This kind of very high quality stream is sometimes referred to as an "editing stream." Sure, there are decoders for it, but sometimes these formats are very, very obscure.
If they have a video in one of these editing stream formats, then the argument that it has been faked becomes almost impossible to argue.
From my experience with the bad guys (which I have some), they're too dumb to realize this and they'll get totally blind-sided in court.

I've done a lot of work with DCT-based encoding/decoding. There are some pretty sophisticated ways to be able to tell if a stream has been modified from an original recording device. I'll leave it there. Sounds like the intelligence agencies have good peepz who know their shit.
