Yeah, seems a possibility at least. Sometimes the letter of the law is obvious, other times it's a matter of interpretation. Last time I checked there are at least a dozen ways you can get charged with murder as a federal crime. I think they all require some other extenuating circumstance (like kidnapping across state lines).
