Bobbitt's whole putative thesis is that "history proceeds by successive constitutional forms."
He then says "now a new form is coming, cuz it's the historical law"– and from this, we are to conclude "ah, now history is moving from the nation-state to the market-state, therefore, we should give up our political rights to multi-national corporations!"
And in reality "maximize the opportunity of the people" might be plausibly thought to be the driving impulse behind a change to "market-state", but in point of fact, in the actual world we are in, it is being used as a fig leaf to cover the fact that entrenched capitalist power is now not only bending the state for its own welfare, as it has been for a long time, but is consolidating control to such an extent that they are trying to ease explicit devolution of political rights in favor of that capitalist power structure.
