Has anyone done a dig on how civil forfeiture assets are spent? Could POTUS use El Chapo's assets without congressional approval or do they have to be appropriated by congress? anyone have an idea on who gets to use the funds?

I know he's sponsoring the El Chapo Act in congress to appropriate the assets, but I'm wondering if congress actually has the authority to handle the seized assets, or if they go straight to the executive branch. I haven't been able to find anything out about the procedures.

Interesting, so basically whichever department seizes the assets gets to keep them. The next question would be who seized El Chapo's assets? if the DHS seized or seizes his assets, it sounds like we wouldn't even need congressional approval to spend the money.

follow up, no one has found his assets yet, but it starting to sound like they would go directly to the department that does bypassing congressional approval
