US Pres does not have line item veto power. SCt ruled that in Clinton v. City of New York, back in 1998

Yes. The rule of law isn't suspended. The S Ct will give great deference to the Pres, and in the past (Japanese internment camps) has allowed acts which would probably not be allowed today.
