No. Roberts has been a firm cabal vote. RGB dead leaves a deadlocked SC, 4-4, until RGB's replacement is confirmed by the Senate.

Yes. The rule of law isn't suspended. The S Ct will give great deference to the Pres, and in the past (Japanese internment camps) has allowed acts which would probably not be allowed today.

 

But the rule of law is the rule of law.

Gotta have a case before them on that issue. And they don't.

 

S Ct doesn't just rule on stuff it wants to rule on, there MUST be a case in controversy. That is an absolute requirement.
