Tribunal cannot happen against civilians while courts are still operating. Ex Parte Milligan ensures that. However, if you are declared an enemy combatant, or are associated with declared enemies of the state, then your ass can get a tribunal without the need for considering Ex Parte Milligan. It"s kinda scary, if you think about it, but I believe that is one of the reasons Q asked:
