POTUS does not need a declaration of a state of emergency to fund the wall.

POTUS knows that declaring a State Of Emergency will cause legal challenges and possibly legislation to limit such declarations in the future.

Besides the legal challenges allowing evidence to be introduced, I think POTUS want stronger checks legislated on the presidential power to declare states of emergencies.
