Came across the attached thread and this might be the play.

The National Emergency is a ploy. While it gets hung up in court, the wall is being built.

I even bet that Trump might want the National Emergency to lose in court. Why? To set a precedent so that any President in the future cannot do what Trump is being accused.

Maybe by losing the battle in the courts, that ruling would also be able to be precedent for the DACA case and how it was done by EO under Obama.
