No it wouldn't work retroactively, except maybe it would be retroactive if those emergencies were ongoing. A ruling like that would be unlikely because it would be very upsetting to the way govt has been operating for a long times and it would create uncertainty in regard to the Constitutionality of Executive actions like use of military force. Especially in the modern day, a president cannot, for example, present a case before Congress for war when a missile is on its way.
