New York Times v. Sullivan
In 1964, SCOTUS used MLK “racism” hysteria to unconstitutionally take away States Rights to set its own Libel Laws. Also gave Media the ability to libel any public figure by claiming it was an opinion. Forced the public figure to prove malice which is nearly impossible.
Kathrine McKee v. Bill Cosby
McKee accused Cosby of rape. Cosby hired PR firm to write libelous info about McKee’s character. McKee sued Cosby for libel. Court ruled McKee was a public figure because she had spoken to the press, and therefore, she had no case without proving malice.
Nick Sandmann v. Washington Post
High School Student, Nick Sandmann, sues Washington Post for libel seeking a $250M judgement. Sandmann is a minor and was not a public figure when the libel occured. Kentucky libel laws differ from Federal libel laws. Case will go all the way to SCOTUS.
Jussie Smollett Hate Crime Against Trump
Jussie is alleged to have created a real hate crime against Trump Supporters in the form of a “fake hate crime”. This criminal case will likely cause civil action since the Media coverage libeled “Trump Supporters as racist” which may be subject to a Class Action Suit.
